2 Types of Legally Binding Settlement Agreements in Special Education

Are you the parent of a child with autism that is receiving special education services? Are you tired of your child not getting needed educational services? Are you considering filing for a due process hearing, and would like to know what legally binding settlement agreements are? This article will discuss what legally binding settlement agreements are so that you can help your child receive FAPE.

Due process is a formal process used by parents and special education personnel to resolve disputes between them. Either special education personnel or parents may file for a due process hearing. The hearing is run by a due process hearing officer which in most states are attorneys; that have special knowledge of special education.

The Individuals with Disabilities Education Act (IDEA) which was reauthorized in 2004 allowed for legally binding settlement agreements for the first time. Prior to this any written settlement between parents and school districts, were not legally enforceable by any entity! This is a good change for parents and children, because if a school district writes a legally binding settlement agreement it can be enforced by any state or federal court.

There are two types of settlement agreements under IDEA 2004:

1. If a parent files for a due process hearing for their child a resolution meeting must be held between school districts and parents, within 15 days. If an agreement is reached, a legally binding settlement agreement must be written and signed by parents and school personnel. Either side can void the agreement within 3 business days!

2. If a parent requests mediation and an agreement is reached, a written agreement signed by both parties is also legally binding! There is no 3 day voiding allowed in mediation.

It is extremely important for parents to understand that legally binding settlement agreements only apply to settlements reached during the resolution meeting or mediation.

Many parents thought that they were signing a settlement agreement that was enforceable, only to find out that it was not! If you are having difficulty with your school district and they are now offering a settlement agreement, I would immediately ask for mediation. You should however not consume so great amount of any spice that you feel it irritates.

One way of using urine is to drink it. The oral administration of urine is recommended by health problems in all body parts. One drinks it on empty stomach to get best effect. One only takes 5-10 drops twice a day in the beginning. Within a month one increases the dose up to 2 deciliters (0.84 US cup) twice a day.

Causes of Dog Seizures

In England they often call them “fits” – what happens when the brain loses control of the body. In America, they are more commonly called seizures. The purpose of this article is to provide a brief summary as to some of the many causes of dog seizures.

EPILEPSY. The primary cause of dog seizures is epilepsy, but it is important to make the distinction that not all seizures are attributable to epilepsy. The most common form of epilepsy was made known to the world by a group of idiots walking through the woods one day and they all found themselves on the same path, and collectively observed a wolf in a clearing doing the hokey-pokey. They reported this unusual sighting to the forest rangers and the term “idiopathic epilepsy” was coined. Well, that’s not exactly true, but the scientific reason is a bit more boring and doesn’t make any more sense. In short, the term “idiopathic epilepsy” is a catch-all for when the experts just don’t know what is causing a dog to have seizures.

TOXINS. Unfortunately for dogs, there are all kinds of toxins in their environment, many of which can cause seizures. These toxins range from poisons to get rid of rodents or slugs to flea powders or chemicals that are actually meant for dogs to wear as collars. Antifreeze, insecticides and paint products are also known toxins which can not only induce seizures, but can kill the unwitting animal that ingests them. With early treatment and intervention, most animals have a good to fair prognosis of making a full recovery if they have a seizure as a result of an environmental poisoning.

BRAIN TUMORS. Obviously, one of the easiest things to rule out, as a cause of dog seizures, is whether there is an abnormal growth in the dog’s brain. Growths cause pressure on the brain tissue, which in turn can cause seizures and other neurological abnormalities. Fortunately, there are diagnostic tests (MRI or CAT scans) that can determine if that is the problem; however, only a very small percentage of dog seizures are caused by tumors or head injuries. In either case, anti-epileptic drugs would not be effective for dogs suffering from seizures caused by either of them.

TICK INDUCED DISEASES. The bite of the bloodsucking arachnid known as a tick can cause Lyme Disease or Rocky Mountain Spotted Fever, both of which can cause dog seizures. If the tick is discovered within the first 24 hours after it has attached itself to the dog, the chance of infection is greatly reduced. There are antibiotics that can kill Lyme Disease, and most dogs respond quite well in general to antibiotics.

DISTEMPER. Distemper, in which a fever develops, then diarrhea and dehydration, can cause seizures in dogs, especially puppies, when they lose their maternal antibodies at about the age of 3 months. Only through the use of vaccinations can this debilitating disease be prevented, and once a dog has acquired it, they have a fight ahead for their very lives.

How to Swim – Butterfly Stroke

The butterfly stroke is named after the graceful motion of a butterfly’s wings. It is one of the fastest swim strokes, and is also considered to be one of the most difficult. However, with practice and perseverance, you can perform the butterfly stroke with confidence and efficiency.

Before beginning, it is preferable to consult your physician and be in good physical condition. It is also a good idea to have some familiarity with the other basic swimming strokes. The best option is to have a qualified swim coach to instruct you, but if this is not possible you can certainly teach yourself the butterfly stroke.

The butterfly is broken down into two components: the kick and the stroke. The kick is done with the legs together in an undulating motion originating from the hips, flowing through the knees and then through the feet. This is known as a dolphin kick. Often it is helpful to practice the dolphin kick separately either with a kick board or while wearing flippers. This helps familiarize swimmers with the power and fluidity of the kick.

The stroke performed consists of three basic parts: the pull, the push, and the recovery. The stroke can be practiced separately while stationary in the water. Start with your arms out in front of you, shoulder width apart. Next, in a continuous motion bring your arms down through the water to waist-level, achieving the pull – pulling yourself through the water. Continue the arm motion with a push through to the hips or mid-thigh, and then bring your arms up out of the water, over the top of your head, and back around to the starting point to perform the recovery. This completes the motion of the stroke.

After mastering these two components, the next step is to put them together. This is best done with an understanding of the two-kick cycle. The two-kick cycle is performed by first pushing off of the wall of the pool with the dolphin kick. When you are ready to breathe, execute a pull and push, lifting your head out of the water and taking a deep breath. As you are pulling and pushing, do a giant kick to lift up out of the water and breathe. As you perform the recovery, kick back down into the water to glide for approximately 1-2 seconds. This completes the butterfly stroke.

Lastly, it is always recommended to learn butterfly stroke only after you are proficient in other basic strokes such as freestyle or breast stroke.

How many times has someone (an employer, sister, father, spouse) said to you, "Could you be a little more cheerful with the customers" or "I wish you were a little neater around the house?" Many times in the course of our lives, all sorts of people will ask us to be something we are not. Some will be polite about it and some will not.

When I was younger, I spent a lot of time and effort (before and after I got over the rebellious teen years, that is) trying to be everything everyone wanted me to be. Well, I was never going to be tall, blond and beautiful and luckily no one every required that of me, but there were plenty of other requirements that I just was not meeting naturally.

It actually started quite early. For my father, I was never smart enough or did anything quite well enough. For my mother, I was never neat enough. I wanted to be someone who screwed her socks on and my mother wanted someone who kept the ribbing of hers socks straight at all times. I wanted to draw and paint and make things with my hands, and my father wanted me to be a doctor.

I was shy as a child and I still am to a degree. So, why I chose retail, I will never know. Maybe it was for the lessons it would teach me. At any rate, I was never outgoing, or forceful enough for most of my employers, even though I always did the best that I was able.

At a time when I was going through a period of having migraine headaches every day, I worked for a family-owned clothing and accessories business as a salesperson. They were particularly dissatisfied with my level of cheerfulness. Just about every night, I would complain to my husband about what the owners had said to me that day. What did they expect? I was doing the best I could. One night, my husband said three little words that changed my life. He said, "Just be yourself." What an amazing idea!

It took a couple of weeks for the full importance of what he had said to me to sink in. As it turned out, the self I was at that point had to admit that she really should not be working at all right then. That she had to get well first and stop having migraines every day before thinking about taking on another job. It was a scary prospect. We had just moved to Arizona and bought our first house. We had a mortgage and needed the two incomes. I had to work or we might lose the house.

We managed, however, to keep the house and while I was not working, I had the time to figure out why I was getting the migraine headaches and what I had to do to stop having them. Do yourself a favor and be honest with yourself about who you are. Do not wait until you are 42 years old to get started. It can be a little frightening at times because of some of the choices it causes you to make, but it is well worth it. Do not lie to yourself about whom and what you are. Get to know yourself and be genuine with yourself. You will be surprised at how liberating and confidence-building it can be. When you are genuine with yourself, you can learn to love yourself. And when you love yourself, anything is possible.
